battle for the soul of the Internet?

“The battle for the soul of the Internet” has been around for a long long while. Other players may have entered the game now. And never mind US law, for the longest time ICANN has been operating under California law, seeing as it is an organization incorporated in the state of California and hence subject to that state’s jurisdiction. And though not many people are aware of this, US legal interpretations of jurisdiction and law courts’ misunderstanding of the nature of the Internet have allowed them to think they can “apply” their laws to the Internet. It’s about time this aspect of not just internet law but wider governance issues become a part of public discourse. the point is i don’t think anyone wants any one crappy nation-state to extend their pernicious influence, that’s what the whole libertarian vision of the Internet has always been. Clearly the problem of Internet governance is a hard one to solve because it so clearly reflects the problems of global governance in general.
